Smoking Gun Recovered From School District's Illegal ADA Violations

If you read last week’s story about the Clark County School District being caught red-handed violating federal law, you are probably glad that you read the only truly independent newspaper in southern Nevada! All the local newspapers were given this story and chose to protect the guilty and further harm the innocent. We understand the dilemma of our competition. CCSD has about $400,000 a year in advertising and perks to spread around with the press. It appears that not all newspapers are interested in the news.

After last week's story broke, Suzanne Thomas, who filed the Americans with Disability Act (ADA) complaint against the School Board, got a hold of CCSD’s “Transition Plan.” The Transition Plan is a federal requirement for the school district to fix buildings that are not in compliance with federal law. After many attempts by Thomas to obtain the plan and weeks of being given the run around by CCSD, a retired CCSD employee turned over the sad excuse for a ”Transition Plan.” Documents in the possession of the Tribune provide evidence of the District's intentional disregard of the law and consultants' recommendations. Reports dated 1994 and 1999 show deficiencies brought to the attention of the District by consultants were never corrected. The Tribune obtained internal CCSD documents proving that they are knowingly violating the law. They detail a disabled teacher who in 1997 was unable to get into her portable classroom building and many others.

IMMIGRATION REFORMED!

Well, Arizona’s immigration law has continued to stay in the national spotlight.  Hispanic groups across the country are protesting a law they haven’t even read.  This law is right in line with the current federal law and really gives us no new powers; yes, I am a police officer!  The only real change in the law for Arizona police officers is that now they can simply ask a person if they are here illegally when they are stopped for some other crime or misconduct.  Hispanics are all up in arms and ready to fight, but what are they fighting for?  The truth is they don’t even know because very few people have read the bill.  The bill says that an officer must have a “reasonable suspicion” to stop a person for a crime; officers now have the right to ask if they are here in the country illegally and conduct a records search to determine a person’s residency status.

This bill does not allow an officer to stop a person with “brown” skin or a Hispanic accent just because they want to deport them.  The officer must have another reason for stopping a person.  As expected, our elected officials and those running for office have chosen to further the misunderstanding of the law and politicize it in hopes to win the Hispanic vote.  I ask all Hispanics not to fall for this and do some simple research of the bill; do not let others tell you what they think the bill says.  The confusion surrounding the law has awakened the Harry Reid campaign and they have prospered by further misinforming the public; this is classic Reid campaigning.  On the Republican side, Sue Lowden has said, “ I’m not sure it is constitutional.” Lowden’ s  statement further shows she is not competent enough to be a U.S. Senator and that she has not read the bill.  Maybe a ride-along with the local police department would help Lowden with her lack of knowledge.  There is an old saying, “It is better to keep quiet and let people think you are stupid, rather than to speak and prove them correct.”

Extra! Extra! Reid all about it!

Commentary - John Schutt

After a yearlong battle over healthcare reform, the bill finally passed and Americans were promised the plan would save millions of dollars.  A new analysis of the healthcare bill conducted by Centers for Medicare and Medicaid Services shows that the bill is going to cost far more than what the Obama administration led Americans to believe.  This is exactly what the Republicans have said for over a year now.  Congressman John Boehner, R-Ohio, said that this report shows that not only will the healthcare bill exceed the Democrats projections, but it will end up forcing over 7 million seniors off their current Medicare coverage. Harry Reid led the healthcare fight and as usual he has left Nevadans footing the bill; anyone hear of the Silver State Stimulus Kickback? Probably because it doesn’t exist, Nevada did not receive any of Reid’s’ Senate specials.

School Board Claims Over $10 Million Savings By Switching To 9-Month School

Commentary - John Schutt

By John Schutt

Special to Las Vegas Tribune

After spending the last few years telling us that 12-month schools would be much cheaper and that our children would do better in a 12-month school, we are now told the school district can save money by reverting to a 9-month school. Prominently mentioned in this week's Clark County School District public relations information is a big savings that CCSD Trustees are claiming to get by moving elementary schools from a year-round schedule to a 9-month schedule. This is very surprising to me because when I ran for the School Board during the 2008 election, Terry Janison reported that the Chief Financial Officer of CCSD calculated that a 12-month school was slightly cheaper to operate. Who are we to believe if we can't trust Janison, the school board president? What happened during the last two years that made a 9-month school cheaper than a 12-month?

Incompetent planning and political paybacks to contractors and architects who donated to the campaigns of Trustees Edwards and Janison (Vice-President and President of the School Board) led the district to spend $50 million on the building of unneeded schools. Four schools started in October are now going to be ready for operation at the start of the next school year. Now the race is on to purchase portable classroom units like they are going out of style. The public may want to take a look at those portable units; not one of them is wheelchair or walker accessible, but that should not be too big of a surprise - the District has a very poor track record when it comes to helping those that are handicapped.
